Who we are

What we collect
When you register an interest, book a viewing, request a valuation or make an enquiry, we collect your name, contact details and what you have told us you are looking for.
If you go on to buy, sell, let or rent through us, we collect what the transaction requires: identification documents, proof of address, proof of funds or income, references, and bank details for rent or settlement. Landlords and tenants give us tenancy and maintenance records over the life of the tenancy.
We also collect technical information when you use this website, which is covered by our separate policy on browser storage.

Why we are allowed to hold it
Most of what we hold is processed to take steps at your request before entering a contract, or to perform a contract you have with us.
Identity and anti money laundering checks are carried out because the law requires it of estate agents. Keeping records of transactions and tenancies is also a legal obligation.
We rely on our legitimate interests to run and improve the agency, to keep our records accurate, and to tell you about properties that match what you asked for. Where we want to market to you beyond that, we ask for your consent first and you can withdraw it at any time.

Who we share it with
We share what is necessary with the other side of a transaction and their agent, with solicitors and conveyancers, with referencing and credit check providers, with deposit protection schemes, with contractors attending a maintenance job, and with mortgage professionals if you have asked for an introduction.
We use service providers for our website, email, CRM and property portals, who process data on our instructions only.
We will disclose information where we are legally required to, including to HMRC and to law enforcement.
We do not sell your personal information.

Sending data abroad
Our overseas work means we sometimes share enquiry details with developers or agents outside the United Kingdom, with your knowledge, so they can answer your enquiry. Where we do, we make sure the transfer is covered by an adequacy decision or by standard contractual clauses.

How long we keep it
Enquiries that do not lead anywhere are kept for two years so we can pick up the conversation if you come back to us.
Records relating to a completed sale, purchase or tenancy are kept for six years after the relationship ends, which is the period we may need them for tax, accounting and legal claims. Anti money laundering records are kept for five years from the end of the business relationship, as the regulations require.

Your rights
You can ask us for a copy of the information we hold about you, ask us to correct it if it is wrong, ask us to delete it, ask us to restrict how we use it, object to processing based on legitimate interests, and ask for your data in a portable format.
Write to info@eliteestateagentsnottingham.com and we will respond within one month. There is no charge unless a request is manifestly unfounded or excessive.
If you are unhappy with how we have handled your information you can complain to the Information Commissioner’s Office at ico.org.uk, but we would rather you gave us the chance to put it right first.

Keeping it secure
Access to our systems is restricted to staff who need it and protected by individual accounts, and our devices and storage are encrypted. If a breach occurs that is likely to risk your rights and freedoms, we will report it to the Information Commissioner’s Office within 72 hours and tell you where we are required to.

Changes to this policy
If we change how we handle personal information we will update this page and change the date at the top. Material changes will be brought to your attention directly.
